This Privacy Notice (“Notice”) describes how Materia Group Corporation, dba Material Bank, and related group companies as specified in this Notice ("Material Bank", "we", "us", or "our"), collects, uses, stores, discloses, and protects the personal data (defined below) of individuals who interact with Material Bank and our services ("User", "you" or "your"), and the rights and choices you have with respect to your personal data. This Notice applies globally, including to Material Bank’s privacy practices regarding personal data of Users in North America, including the United States and Canada, the European Economic Area ("EEA"), the United Kingdom (“UK”), and Switzerland (for convenience the EEA, UK and Switzerland may be collectively referred to as the “EU”).

“Personal data” is any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. There is a subcategory of personal data called “sensitive personal data,” which requires elevated protections under certain privacy laws. Material Bank does not collect sensitive personal data (as defined by applicable data protection laws) in the contexts covered by this Notice.

Personal data does not include publicly available data, which is information that is lawfully made available from federal, state, or local government records. Personal data also does not include data that is anonymous or de-identified, such as summary statistics or metrics.

A. Scope

This Notice applies globally to your interactions with Material Bank, including when you access, use or interact with our services, such as our website, related webpages and URLs (the “Website”), our platform, and other technologies that we operate (together with the Website, the “Services”). The Services also include fulfillment by Material Bank of orders placed by approved Users for material samples and other items (“Samples”) provided by participating partners and brands on Material Bank (“Brands”).

You may use the Services as a visitor to the Website without creating or logging into a Material Bank account (“Visitor”), as a member when you register or are logged into your Material Bank account (“Member”), or as a representative authorized by a Brand (“Brand Rep”). Brand Reps may also register as Members associated with the Brand they represent (“Brand Member”). For purposes of this Notice, Users may be used to refer to Visitors, Members, Brand Reps, and/or Brand Members, as specified, or as the context requires. The provisions addressing Members apply to Users who register to become a Member but were not approved or have not yet been approved as a Member as described in this Notice.

This Notice does not apply to personal data collected from job applicants or employees. If you have questions about those practices, please contact Material Bank using the information in the “Contact Us” section. 

B. Minimum Age Requirement to Use Our Services

Material Bank does not direct the Services to or knowingly collect or disclose the personal data of minors under age 18. If we learn a minor under 18 has provided us with personal data, we will take immediate steps to delete such information.

C. Personal Data We Collect and Why We Collect It

The personal data we collect about you depends on whether you are a Visitor or Member, the context of your interactions with us, the choices you make, the Services you use, and applicable law, as described below.

1.  Information You Provide Directly to Us

a.  Users. We collect the following categories of personal data from Users:

1.  Identifiers. We collect your name, email and phone number when you register to create an account to become a Member. Authentication and login to your account are provided through a third-party service; when you sign in, a one-time code is sent to your email address to verify your identity, and we process your email address and related authentication data for this purpose. We use your name and email address to create an account for you to use the Services. Although not required, Users may provide us with a mobile phone number during the registration process. If you opt in, we may send you promotional text messages. You may opt out of receiving text messages at any time as further discussed below and in our SMS Terms (for Users in the United States). From time to time, we may partner with trade associations, and we will collect a trade association ID number to create an account for you.

2.  Professional Information. We collect the following professional information during registration and as you may further provide to us from time to time:

•  Member Profile Information. Your job title, job type, company name, company size, work phone number, work email address, primary area of specialization, company address, and company type (“Member Profile”). We use this information to create a profile and account for you to use the Services. We also use your email address to send you marketing materials from Material Bank, unless you opt out.

•  Project Information. Information about the project associated with your use of the Services, including the project type, project phase, project location, budget, and any additional information and details you provide (“Project Information”). When you order Samples from us, we provide the Brands that supplied the Samples you ordered with your Member Profile and Project Information so the Brands can understand who received their Samples and how and where their products may be used.

•  Student Information.  If you are a student or educator, we collect your school name, program name, school email address, graduation date, if applicable, and related information to create an account for you and to send you marketing materials, unless you opt out.

3.  Transaction Information.  When you place an order for Samples, we collect the shipping address you provide for us to send you the Samples you ordered, which may be a residential or home address if that is what you provided. We provide the shipping address to the Brands that supplied the Samples you ordered so they can understand who received their Samples and to fulfill out of stock Samples, if applicable. We also collect your sample order history, as applicable, to provide the Services, including for your reference, to improve our Services, and to recommend more relevant Samples to you.

4.  User Inferences. We collect information about your preferences when you interact with the Services, such as when you order Samples or indicate interest in a particular Brand, or based on the category of Samples you ordered, and the Project Information you provided. For example, if you order three Samples from Brand A, we will infer that you may be interested in more Samples from Brand A in the future, or if you order Samples for part of a project, we may infer that related or complementary Samples or categories of Samples may also be relevant to your project. We use this information to provide you with personalized Services, including in our search results and recommendations.

5.  Other Personal Data. You may choose to submit other personal data to us via our messaging features, webforms, or surveys that we may make available to you from time to time. We use this information for the purposes described at the time of collection, or as reasonably understood given the context of collection, such as to develop new features, enhance our Services, provide customer support or collect feedback to improve our Services, including as further described below.

•  Contacting Brand Reps. The Services allow you to contact Brand Reps by email through Material Bank. When you send a message through our Services, the Brand Rep receives your email address so the Brand Rep can reply to you directly. Messages that you send through our Services may be viewed and retained by us. Replies to your message from a Brand Rep will come directly from the Brand Rep and will not be received, viewed or retained by us unless Material Bank is copied on the Brand Rep’s reply. We may monitor and view communications sent through our Services or on which we are copied to facilitate communications between, and to provide support to, our Members and Brands, and to provide and improve the Services.

•  Professional Associations. If your eligibility to use the Services as a Member is based on your employment by or association with a particular company, firm or other organization, we may provide your account information, including your personal information, such as your internet and other electronic network activity information, order history, and messages you send through the Services, and your internet and other electronic network activity information, to the organization associated with your registration. We may provide this personal data on an aggregated or individual basis as needed to such company, firm or organization. For example, if a Member registers for an account based on the Member’s employment and email address associated with a design firm, that firm may be granted access to the Member’s account when the Member leaves the firm.

•  AI and Machine Learning. We may utilize information you provide, including Project Information, to improve, develop and enhance our artificial intelligence (“AI”) and large language model (“LLM”) capabilities to improve and enhance our Services, including by creating new functionalities. For example, we can analyze Project Information to deliver more relevant insights to our Members and Brands, and to gain a deeper understanding of User needs. Any output data generated by our AI and LLM systems may be used or disclosed as provided in this Notice or aggregated and de-identified so that it cannot be associated with individual Users.

b.  Brand Reps. We collect the following information from you as a Brand Rep:

1.  Identifiers. We collect your name, email address, phone number, and territory you represent, from you. We may also collect this information from the Brand you represent, including when such Brand adds you as a Brand Rep in Brand Central (Material Bank’s portal for Brands), and assigns you a territory in Brand Central. We use this information to provide you with access to Brand Central and to automatically approve your registration if you choose to create an account with Material Bank. We also use this information to display you as a Brand Rep on our Website. For purposes of your Brand Rep profile, you may choose to upload your photo, or we may obtain your photo from the Brand you represent or from a publicly available profile online, if available.

2.  Transaction Information.  We collect your order history when you order Samples as a Brand Member to provide the Services, including for your reference and tracking purposes.

3.  Professional Information. We collect your job title, primary area of specialization, company name, company size, work phone number, which may include a mobile number if you choose to provide it to us, work email address, company address, and company type when you register with Material Bank as a Brand Member. We use this information to create an account for you to use the Services. We also use your work email address to send you marketing materials, unless you opt out.

4.  Other Personal Data. You may choose to submit additional personal data to us through our Services, including our messaging features, webforms, or surveys. We use this information to provide you with the Services and for the purposes described at the time of collection, or as reasonably understood given the context of collection, such as to develop new features, enhance our Services, provide customer support or collect feedback to improve our Services, including as further described below.

•  Contacting Members.  The Services allow Members to contact Brand Reps by email through Material Bank. When a Member sends a message to you as a Brand Rep through our Services, the Member’s message will be sent directly to your Brand Rep email. If you copy Material Bank on your reply to the Member, your message will be received and may be viewed and retained by Material Bank. Material Bank may monitor whether a Member’s inquiry was promptly replied to by a Brand Rep to facilitate communications between, and provide support to, our Members and Brands, and to provide and improve the Services.

•  AI and Machine Learning. We may utilize information you provide to improve, develop and enhance our AI and LLM capabilities to improve and enhance our Services.

c.  Visitors. We do not collect personal data directly from you when you access our Website as a Visitor.

d.  No Sensitive Data. We do not collect sensitive data. Please do not submit any sensitive personal information to us through the Services, including through any messaging features, webforms, surveys or otherwise through the Website (examples of sensitive personal data include information such as your social security number, race, sexual orientation, and religious affiliation).

2.  Information We Collect about You from Third Parties

a.  Users. We collect the following categories of personal data about you as a User from third parties:

1.  Identifiers. 

•  We collect your name when your employer is a Brand or an organization with an enterprise relationship with us and they refer you to register for a Member account. We use this information to preapprove your registration.

•  We collect your name when a current Member refers you to us via our referral program, including by sending you an invitation to join Material Bank. We use this information to consider your registration for a Member account.

2.  Professional Information.

•  We collect your work email address and territory (e.g., state or region) when your employer is a Brand or an organization with an enterprise relationship with us and they refer you to register with us. We use this information to preapprove your registration.

•  We collect your job title and work email address when someone you know refers you to us via our referral program. We use this information to consider your registration for a Member account.

3.  Project and Specification Data. We collect project, specification, and transaction data from design, specification, and technology partners with whom we work. This data may include identifiers, such as an individual's or company’s name, along with project and order details. We use this data to understand whether Users who order Samples on our Services ultimately specify or purchase those products in their projects, and to generate related insights and analytics.

4.  Other Personal Data. We may collect your social media information or other online profile to confirm your credentials as part of our Member vetting process. For example, we may conduct an online search to verify your work with a particular design or architecture firm to confirm your eligibility to use the Services as a trade professional.

b.  Brand Reps. We may collect additional personal data about you as a Brand Rep from the Brand you represent to facilitate our Services. For example, we may collect an alternate work phone number or a secondary work location for you, to help us and our Members reach you. We may also receive your territory and a photograph of your likeness to associate with your Brand Rep profile on our Website.

c.  Visitors. We do not collect personal data about you as a Visitor from third parties except in the limited capacity outlined in the next section.

3.  Information We Collect about You Automatically

We collect internet or other electronic activity information when you use our Services, including the Website, regardless of whether you are a Member or Visitor. For example, we collect your usage data, including your IP address, the model of your computer or mobile device, your internet service provider, browser type, and operating system when you interact with our Website. Some of this information, including your IP address, is collected through cookies and similar technologies and through our own tracking tag or pixel, which allows us to recognize your device and collect your IP address and usage information when you access our Website or interact with the Services. We also collect your interaction data such as access timestamps, referring and exit pages, which links you clicked, the pages you viewed, how long you spent in certain areas and what information you searched for on the Website, using behavior analytics tools such as Hotjar and Clarity. We use the information described in this section to improve our Services by understanding how Users interact and use them. For more information about how we collect and use your usage data on our Website, please refer to our Cookie Policy (NA) or our Cookie Policy (EU), as applicable to your location.

D. Legal Bases for Processing (EU)

If you are located in the EU, we rely on the following legal bases to process your personal data, respectively:

1.  Performance of a contract: to provide the Services under our Terms of Use, including for purposes of creating and administering your account, fulfilling and delivering Sample orders, and for Brand Members, managing invoicing and contract reviews.

2.  Legitimate interests: to conduct Member vetting, Member communications, marketing operations, events and trade shows, and content management (including event photos, as applicable); to operate, improve, and secure the Services; to generate insights and analytics; to prevent fraud and misuse; to develop our business (including AI/ML functionality); and to facilitate corporate transactions. Where we rely on legitimate interests, we have balanced those interests against your rights and freedoms and concluded that our processing does not override them.

3.  Consent: where required by applicable law (for example, certain electronic marketing communications and the use of non-essential cookies), you may withdraw consent at any time without affecting the lawfulness of prior processing.

4.  Compliance with a legal obligation: to meet applicable legal, regulatory, tax, or accounting requirements; to respond to lawful requests from authorities; and to manage data subject rights requests.

E. Disclosing Your Personal Data

We disclose your personal data as required by law and as part of our business practices, as described below.

1.  Connecting Members with Brands

We connect Members with the Brands that supply the Samples the Member ordered. When a Member orders a particular Sample, we will share the Member Profile, Project Information, and information about the specific Brand Samples ordered. We provide this information to the Brand that supplied the Samples so the Brand can follow up with the Member about the potential use of the Brand’s materials in the project associated with the order.

2.  Professional Associations 

We may share your personal data with your employer if your account is associated with your employer, or with your school, if you are a student Member. We may also share your personal data with the Brand you represent, and with Brands that invite you to represent them, if you are a Brand Member or Brand Rep. For example, some companies or firms may establish a relationship with Material Bank so all their designers can have automatic access to the Services upon registration. In such cases, the companies or firms may have access to all activity of Member accounts created with an email address of such company or firm.

3.  Third-Party Service Providers

We share your personal data with third-party service providers that require access to your information to support our operations and delivery of the Services, including:

•  Professional services advisors to protect and manage our business interests;

•  Billing and payment providers to authorize, record, settle and clear transactions;

•  Cloud hosting providers to provide data storage and processing services;

•  Customer support providers to respond and resolve member inquiries and support requests;

•  Corporate and information technology services to facilitate business operations and communications;

•  Analytics companies to perform marketing analytics or market personalized products to you; and

•  Any other suppliers, sub-contractors, partners, vendors, and other service providers acting on our behalf.

We also may use and disclose aggregate information that does not identify or otherwise relate to an individual for any purpose unless we are prohibited from doing so under applicable law.

4.  Business Transfers

As we continue to develop our business, we may buy, sell, or share assets in connection with certain transactions, such as a merger, acquisition, reorganization, sale of assets, or bankruptcy. In such transactions, User information is often a transferred business asset. In the event that Material Bank or all or substantially all of Material Bank’s assets are acquired, User information may be transferred as part of the assets.

5.  Legal or Public Authorities   

We disclose personal data to legal or public authorities when disclosure is reasonably necessary to:

•  Enforce this Notice;

•  Comply with any applicable law, regulation, subpoena, legal process, or enforceable governmental request;

•  Detect, prevent or otherwise address security, fraud, or technical issues;

•  Enforce our contractual obligations, including investigation of potential violations; or

•  Protect against harm to the rights, property, or safety of Material Bank, you, or the public as required or permitted by law.

F. Do Not Sell or Share

We do not sell your personal data to third parties. We share your personal data with our vendors through cookies and similar technologies for targeted advertising and analytics purposes to serve you with personalized ads and to better understand our Website Visitors and Users through our use of third-party advertising and analytics tools, such as Google Analytics. To opt out of this sharing, click on "Your Privacy Choices" which can be found in the footer of our Website. If you have a legally recognized browser-based opt-out preference signal (such as Global Privacy Control) turned on via your device browser, we recognize such preference in accordance with applicable law.

We do not sell or share personal data of minors under 18.

G. Do Not Track and Global Opt-Out Mechanisms

Some web browsers may be configured to send Do Not Track (“DNT”) signals to Websites, or Users may use similar mechanisms, to indicate a User’s preference that certain web technologies not be used to track the User’s online activity. Because there is not yet a consensus on how companies should respond to web browser-based DNT mechanisms, we do not respond to web browser-based DNT signals at this time. Please note that DNT is a different privacy mechanism from the “Global Privacy Control” referenced in Section E above.

You may manage the Cookie Settings that apply to you as a User by visiting the “Your Privacy Choices” link in the footer of our Website or by visiting our Cookie Policy (NA) or our Cookie Policy (EU), as applicable to your location, and clicking the “Cookie Settings” button in the “Your choices” section.

H. Cookies and Other Tracking Technologies

When you visit our Website, we use cookies and similar technologies such as web beacons, alone or in conjunction with cookies, to automatically collect certain technical information from your browser or device. For more information about how we use cookies and similar technologies and to learn how to manage them, please see our Cookie Policy (NA) or our Cookie Policy (EU), as applicable to your location.

I. Transferring Your Personal Data

Material Bank is headquartered in the United States and operates the Services globally. Your personal data may be transferred to, stored in, and processed in the United States and other countries where we or our service providers operate. These countries may have data protection laws that differ from the laws of your country of residence. Where personal data is transferred from the EU to a country not covered by an adequacy decision, we rely on appropriate safeguards, including the European Commission's Standard Contractual Clauses, together with any supplementary technical, contractual, or organizational measures identified through our transfer impact assessments. J. Retaining Your Personal Data

We retain your personal data for the necessary period to fulfill our legal and contractual obligations; support business operations; develop the Services; resolve disputes; and enforce our rights. To maintain the security of Member accounts, we may require you to periodically re-verify your identity and ongoing affiliation.

The criteria we use to determine the retention period include the following:

•  The amount and type of personal data;

•  Our reasons for processing the personal data;

•  The potential risk of harm from unauthorized use or disclosure of the personal data;

•  Whether we need the particular personal data to achieve our business purposes; and

•  The legal requirements that apply to the personal data.

K. Protecting Your Personal Data

We are dedicated to safeguarding your personal data. We employ administrative, physical, and electronic measures designed to protect your information from unauthorized access. For example, we use commercially reasonable security measures such as encryption, firewalls, and secure socket layers/transport layer security (SSL/TLS) to protect information.

Please note that no security system is impenetrable. Accordingly, we do not guarantee the security of our databases, or that information you provide will not be intercepted while being transmitted to us over the internet or other network. Any information you transmit to us is at your own risk. We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored “personal data” (as defined in applicable state statutes on security breach notification) to you via email or conspicuous posting through the Services in the most expedient time possible and without unreasonable delay, as consistent with (a) the legitimate needs of law enforcement or (b) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

L. Your Privacy Rights and Choices

Depending on your country, state, or region of residence, you may have some or all of the following rights with respect to your personal data. These rights are not absolute and are subject to conditions, limitations, and exceptions under applicable law. Where you exercise a right, we may need to verify your identity before we can respond, and we may decline requests where an exception applies.

1.  Your Privacy Rights 

a.  Right to Know: You have the right to know the categories and specific pieces of your personal data we have collected. At your request, we provide a copy of the information in a format that you can read, use, and transfer (technology permitting).

b.  Right to Correct: You have the right to request that we correct any of your personal data we have collected. 

c.  Right to Delete: You have the right to request that we delete any of your personal data we have collected. Please note that if you request to delete certain personal data, we may not be able to provide you with certain Services; for example, if you request we delete your company address, we will no longer be able to ship Samples to you at that address.

d.  Right to Request Information: You have the right to request information about the collection, sale, and disclosure of your personal data. 

e.  Right to Opt Out of Automated Decision Making: You have the right to object to our processing of personal information for automated decision making. At your request, we will stop processing the data for that purpose upon your request.

f.  Right to Opt Out of the Sharing of Information for Targeted Advertising: You have the right to opt out of the sharing of personal information for targeted advertising.

g.  Right to Non-Discrimination: You have the right to not receive discriminatory treatment for exercising any of your privacy rights. We do not treat anyone differently for exercising any of the rights described above. 

h.  Right to Appeal: If we deny your privacy request, you have the right to submit an appeal by sending an email to privacy@materialbank.com.

i.   Right to Data Portability:  You may request a copy of the personal data you provided to us in a structured, commonly used, and machine-readable format, and to have it transmitted to another controller where technically feasible.

j.   Right to Restrict Processing:  You may ask us to restrict the processing of your personal data in certain circumstances.

k.  Right to Object: You may object to our processing of your personal data where we rely on legitimate interests.

l.   Right to Withdraw Consent: Where we rely on your consent, you may withdraw it at any time. Withdrawal does not affect the lawfulness of processing based on consent before its withdrawal.

m.  Right to Lodge a Complaint: You may lodge a complaint with your local supervisory or data protection authority (see the "Complaints" section below).

2.  Your Choice to Unsubscribe or Opt Out

a.  Marketing emails. If you no longer wish to receive marketing emails from us, visit the “Opt-Out” or “Unsubscribe” link at the bottom of any Material Bank email to remove yourself from our marketing list. You may not unsubscribe from transactional emails. If you do not wish to receive any transactional emails from us, you can unsubscribe from our Services as described below.

b.  Text messages. If you previously opted in to receiving text messages from us and you subsequently wish to opt out of receiving text messages, text STOP to the telephone number from which Material Bank sent you the text messages or email us at support@materialbank.com. Users in the US may also visit our SMS Terms for additional information.

c.  Unsubscribe from our Services. If you no longer wish to receive our Services, you can contact us through support@materialbank.com or the address in the Contact Us section provided below.

3.  Exercising Your Rights 

You may exercise your privacy rights by contacting us as described in the Contact Us section or by using one of the following methods as provided below:

a. Privacy Webform. You may make a privacy request through the applicable privacy webform as follows: 

• If you are in North America, use our privacy webform available here.
• If you are in the EU, use our privacy webform available here.

b. Cookie Preferences Center. You may also opt out of the sharing of your personal data for targeted advertising by visiting our cookie preferences center which may be found at the footer of our Website and clicking on the “Your Privacy Choices” link for Users in the United States, or by interacting with our cookie banner for Users in the EU and Canada.

c. Identity Verification. To help protect your privacy and maintain security, we take steps to verify your identity before responding to requests. To verify your identity to make the request and confirm that the personal data relates to you, we send you an automated message via our privacy management tool, OneTrust, to verify your email address. We also check our systems to ensure the information you provide matches our database to determine whether you have a relationship with Material Bank.

d.  Authorized Agents. Depending on where you live, you may have an authorized agent submit an access request on your behalf. If you wish to use an authorized agent, you must provide such party with written permission signed by you. We may deny a request if the agent cannot provide your signed permission demonstrating that you have authorized them to act on your behalf.

If you have unresolved concerns, you may also address any grievance directly with the relevant supervisory authority:

•  If you live in the United States outside of California, you may contact your state Attorney General.

•  If you live in Canada, you may register a complaint to Material Bank regarding our privacy practices at privacy@materialbank.com. You may also file a complaint with the Office of the Privacy Commissioner of Canada or, if you reside in Quebec, with the Commission d’accès à l’information du Québec.

N. Changes to this Privacy Notice

We periodically review and update this Notice to describe new products, processes, or changes to our practices. You can see when we last updated this Notice by referring to the “Updated” date at the top of this Notice. We encourage you to review the Notice whenever you interact with us to stay informed about our privacy practices and the ways that you can help protect your privacy.

If we make significant changes to this Notice, we will notify you by email, via the Services, or by publishing the new Notice on our Website. If you do not agree with the privacy practices disclosed in the Notice, we recommend you stop using our Website and our Services.

P. Notice for California Residents

This section applies to California residents and outlines individuals’ rights and choices with respect to the processing of your personal data under the California Consumer Privacy Act and its implementing regulations (“CCPA”). It also serves as our “Notice at Collection” for California residents.

1.  Data Collection

We collect the following categories of personal data, as defined by the CCPA:

a.  Identifiers (for example, name, email address, mailing address);

b.  Personal information as described in CA Civ. Code Section 1798.80(e) (for example, name, email address, mailing address);

c.  Commercial information (for example, transaction and order history);

d.  Internet or other electronic activity information (for example, device information and Website activity);

e.  Professional or employment-related information (for example, the employer name and work contact information and roles of Members);

f.  Education Information (for student Members, certain details about school, program, and graduation date); and

g.  Inferences based on the data noted above (for example, Sample preferences).

We do not collect sensitive personal information as defined by the CCPA.

Most of the personal data that we collect is directly provided by you, although we may receive personal data from other sources, including third-party service providers and other Members. If, as a Member, your account is associated with an employer or school, we may receive personal data from that employer or school. We collect these categories of personal data from you so that we may provide our Services to you (maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, etc.), ensure the security and integrity of our Website and Services, engage in advertising and marketing related to our Services, and verify and maintain the quality and safety of our Services. For more information on the types of personal data that we collect and the purposes for collection, please see the “Personal Data We Collect and Why We Collect It” section, above.

We retain your personal data as outlined in the “Retaining your Personal Data” section, above.

2.  Data Disclosures

We disclose the categories of personal data listed above to our third-party service providers, vendors and our affiliates. If you place an order for a Sample, we will share your personal data with the Brand that supplied that Sample to allow the Brand to follow up with you on your order. Similarly, if you are accessing the Website or Services in connection with your school or employer, we will share your personal data with your school or employer as necessary for account administration. Apart from our sharing with Brands, employers or schools, as applicable, the third parties that we share your personal data with are as outlined in the “Disclosing Your Personal Data” section, above.

3.  Data Sales and Sharing for Cross-Context Behavioral Advertising

We do not sell your personal data to third parties. We do share your personal data with our vendors for the purposes of cross-context behavioral advertising. The personal data categories shared include identifiers (including IP address and device information), internet and other electronic information, and inferences based on that personal data. To opt out of this sharing, click on the “Your Privacy Choices” link which can also be found on the footer of our Website.

We do not sell or share personal data of minors under 18.

4.  Your Privacy Rights

As a California resident, you have the following privacy rights:

a.  The right to know the categories and specific pieces of your personal data we have collected;

b.  The right to request that we correct any of your personal data we have collected;

c.  The right to request that we delete any of your personal data we have collected;

d.  The right to request information about the collection, sale, and disclosure of your personal data;

e.  The right to request that we limit the use or disclosure of sensitive personal data;

f.  The right to object to our processing of personal information for automated decision making;

g.  The right to opt out of the sharing of personal information for targeted advertising;

h.  The right to not receive discriminatory treatment for exercising any of your privacy rights; and

i.  If we deny your privacy request, the right to submit an appeal by sending an email to privacy@materialbank.com.

5.  California’s Shine the Light Law

California’s “Shine the Light” law allows California residents to request information about how their personal data has been disclosed by Material Bank to third parties for the third parties’ direct marketing purposes. While Material Bank does not generally share personal data with third parties for their own direct marketing purposes, we do share your personal data with Brands at your direction to provide the Samples you order on behalf of the Brands that supplied those Samples.
